These Terms of Use ("Agreement") govern your access to and use of the services, products, and resources offered through GetYourMessageRight.com ("the Website"), operated by PHELPS Media LLC ("Company", "we", "us", or "our"). By purchasing coaching/consultation sessions, participating in The Get Your Message Right! Workshop, or using the Website in any other way, you ("Student" or "you") agree to abide by these Terms of Use.1. Coaching and Consultation Services
The Company offers coaching/consultation services via Zoom meeting sessions, provided in one-hour increments. These sessions may be scheduled with our coaching professionals ("Consultants") to assist you with various topics of personal or professional development.
Additionally, the Company offers a bundle of three (3) one-hour Zoom coaching sessions, collectively titled The Get Your Message Right! Workshop, which includes personalized guidance to help you refine and craft your business or personal brand message, Elevator Pitch, presentation, or communications.
2. Zoom or Webinar Video Requirement
For the safety and effectiveness of the coaching/consultation sessions, Zoom video or webinar video must be on for the entire duration of the meeting. Failure to comply with this requirement may result in the termination of the session without a refund.
3. Image, Audio, Video, and Likeness Release
By participating in any coaching or consultation session with the Company, you grant the Company and its representatives the irrevocable, worldwide, perpetual right to capture and use your image, audio, video, and likeness during Zoom meetings or recorded webinars. This may include but is not limited to recording, broadcasting, reproducing, publishing, and distributing content in any media, whether now known or later developed. You acknowledge and agree that the Company may use such recordings and materials in any way, without compensation to you, for promotional, educational, or other business purposes.
4. Refunds and Cancellation Policy
Due to the personalized nature of the services and the tools provided during The Get Your Message Right! Workshop, no refunds will be issued for any portion of the services rendered. The Get Your Message Right! Workshop consists of three (3) in-person 1-hour coaching sessions, and the tools provided are non-returnable. By purchasing the services, you acknowledge that you have no right to request a refund after the purchase.
5. Ownership of Website Code and Proprietary AI Code
The Website and all its content, including the code, graphics, design, and proprietary AI code used to deliver output content and/or suggestions and recommendations, are the exclusive property of the Company. You agree not to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Website or the AI system, unless expressly authorized by the Company in writing.
6. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its directors, employees, agents, and affiliates, from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Website, participation in coaching/consultation sessions, or any violation of this Agreement.
7. No Warranty and Limitation of Liability
The Company makes no warranties, expressed or implied, regarding the Website or any services provided, including but not limited to any coaching or consultation sessions, suggestions, recommendations, or materials provided during those sessions. You understand that the Company does not guarantee specific outcomes or results.
The Company shall not be liable for any loss, injury, or damage (whether direct, indirect, consequential, or incidental) that may arise from your use of the Website, the coaching/consultation sessions, or reliance on any advice, suggestions, or recommendations offered during the sessions.
8. Compliance with Privacy and Data Protection Laws
The Company is committed to complying with applicable privacy and data protection laws, including but not limited to:
California Consumer Privacy Act (CCPA): If you are a resident of California, you have specific rights under the CCPA regarding your personal information.
